Release and Waiver of Liability

Version: 9 July 2026 — Gravelton PH 2026

As a precondition to my participation in the Gravelton PH and Gravelton Clark 2026 by Specialized Philippines (“Event”), and with full knowledge and consent, I hereby accept and agree to comply with the following terms and conditions:

Event

The Event is a Gravel course race for cycling enthusiasts that will be conducted on 24 and 25 October 2026 at Filinvest Mimosa - Leisure City, Clark Freeport Zone, Pampanga, PH. Participants will partake in a series of off-road gravel courses involving varying obstacles and terrain. The Event is organized by Specialized Philippines, a brand exclusively distributed and existing under Gruppo Innovare Corp. (“Organizer”). The operational conduct of the Event is managed by GoRacePH (“Race Operator”). The Race Operator, including its directors, officers, employees, agents, and representatives, shall be entitled to the full benefit of all releases, indemnifications, waivers, limitations of liability, and other protective provisions extended to the Organizer under this Release and Waiver of Liability, to the same extent and on the same terms as if the Race Operator were expressly named in each such provision.

Personal Responsibility

I willingly registered for the Event with complete knowledge and understanding that I am responsible for any and all incidents and consequences arising out of my own actions or omissions. I endeavor to participate in the Event in a spirit of sportsmanship and camaraderie, and in a manner that shall not endanger myself or others.

Representations and Warranties

I represent and warrant the following, and acknowledge that the Organizer is relying on these representations in permitting my participation in the Event:

I am in very good physical, emotional, and mental condition, and have no known cardiovascular, respiratory, musculoskeletal, neurological, or other medical condition that would be aggravated by strenuous physical activity, including off-road gravel cycling. If I am uncertain as to my fitness, I have consulted a licensed physician prior to registration;
I am sufficiently experienced, skilled, and trained to participate in the Event, including the specific race category and distance for which I have registered, and I am familiar with the nature of gravel cycling and the terrain conditions associated therewith;
I have not been advised by any medical professional, coach, or other qualified person to refrain from participating in the Event or in other activities of similar nature and intensity;
I am not prohibited by law, regulations, order, contractual obligation, or any other similar authority, including but not limited to any active ban from any sports federation or event organizer, from participating in the Event;
I have read, understood, and have been apprised sufficiently by the Organizer of the proper conduct, rules, regulations, safety precautions, guidelines, and course information for participation in the Event, and I will strictly comply with the same throughout the Event. I completely acknowledge that ignorance of the posted rules shall not be a defense; and
I commit to withdrawing from the Event if, at any time between registration and the date of the Event, my physical, emotional, or mental condition materially changes such that the foregoing representations are no longer accurate. I acknowledge that racing while unfit is solely my responsibility and shall not give rise to any liability on the part of the Organizer.

Participant Conduct

I shall at all times ensure and respect the safety of other persons participating in the Event and will refrain from acts or omissions which may, directly or indirectly, possibly cause injury, loss, or damage to myself and others while participating in the Event. I will fully comply with any and all relevant laws, rules, regulations, and policies, including traffic rules and local ordinances.

Age Requirement

The minimum age to participate in the Event is eighteen (18) years old for all race course distances (50 kilometers, 80 kilometers, and 120 kilometers), as a matter of the Organizer’s event policy. This requirement is not prescribed by statute but is imposed by the Organizer in the exercise of its sound discretion in the interest of participant safety.

Persons below eighteen (18) years of age are strictly prohibited from participating in the Event under any circumstances, regardless of parental or guardian consent. Any waiver or registration form executed by a person below 18 years of age shall be void and of no legal effect, and the Organizer reserves the right to seek reimbursement of any costs incurred from the parent or guardian of such person. I hereby confirm that I am at least eighteen (18) years of age as of the date of the Event. I understand that the Organizer may require me to present valid proof of age at any time, and I agree to comply with such request promptly. Any participant found to be below eighteen (18) years of age shall be immediately disqualified, and their registration fee shall be forfeited without refund, without any liability attaching to the Organizer.

The Organizer reserves the right to adjust the minimum age requirement per race category for future editions of the Event, and any such adjustment shall be communicated through the official event registration channels.

Assumption of Risk

I agree and understand that the Event shall entail engaging in activities or actions involving strenuous physical challenges and harsh environments or terrain and that there are inherent risks of physical injury, illness, property loss or damage, and death. These risks include, but are not limited to, falls, collisions with other participants or course obstacles, equipment failure, course design and marshalling decisions, weather conditions and extreme heat, acts or omissions of co-participants, emergency medical response, and evacuation delays. I expressly assume all risks, whether direct or consequential, associated with the Event.

Sportsmanship

I acknowledge and agree to treat fellow participants, the Organizer, including its directors, officers, employees, agents, or representatives, and third-party service providers, sponsors, and suppliers of the Event with respect and courtesy. I will refrain from engaging in any form of taunting, aggressive behavior, or unsportsmanlike conduct, as may be determined solely by the Organizer.

Release from Liability

I agree that the Organizer, including its directors, officers, employees, agents or representatives, as well as third-party service providers, sponsors, and suppliers of the Event, shall in no case and for no reason be liable to me, my heirs, representatives or assigns for any loss, damage, or injury, whether direct or indirect, sustained by me during my participation in the Event. I hereby release the foregoing persons from any and all claims, losses, costs, liabilities, or causes of action arising out of or in connection with my participation in all activities related to the Event.

Force Majeure

If the Event cannot be held on its scheduled date, due to unforeseen circumstances or events beyond the control of the Organizer, including but not limited to acts of God, natural disasters, government restrictions, or transportation disruptions, the Organizer reserves the right to cancel, postpone, or reschedule the Event. If the Event is canceled or rescheduled, the Organizer shall make reasonable efforts to inform the participants promptly, but will not be liable for any compensation or damage to any party. Any refunds, if applicable, shall be governed solely by the Organizer’s posted refund policy, and no additional compensation for travel, accommodation, or other consequential losses shall be owed by the Organizer under any circumstances.

Indemnification and Free and Harmless

I agree to indemnify and hold the Organizer, its directors, officers, employees, agents or representatives, as well as third-party service providers and suppliers of the Event, free and harmless from and against all liabilities, damages, losses, penalties, claims, demands, suits, costs, expenses (including attorney’s fees), and proceedings of any nature which may arise out of my participation in the Event. In case I cause any damage, loss, or injury to third persons or properties during the Event, I shall take responsibility therefor and will hold the Organizer, its directors, officers, employees, agents or representatives, as well as third-party service providers and suppliers of the Event, free and harmless.

Responsibility for Actions Outside the Event

I acknowledge that the Event has certain physical boundaries, time limits, and organizational limitations. The Organizer is not responsible for any incident or event caused by actions and inactions of persons not involved with the Event or under the control of the Organizer. I agree that the Organizer, its directors, officers, employees, agents, or representatives, as well as the third-party service providers and suppliers of the Event, shall not be responsible for any and all consequences of my actions performed outside the scope and limitations of the Event.

Authority for Marketing

I understand that the Event will be documented by the Organizer for advertising, marketing, and promotional purposes, and I authorize the use of all pictures, videos, or other similar media taken during the Event which feature my image and person in perpetuity and throughout the world, in any media now known or hereafter devised, including social media, digital platforms, and print, and including by the Organizer’s sponsors, partners, and licensees, without any requirement for prior notice, approval, or compensation of any kind.

Refunds and Transfers

In the event of a cancellation, due to unforeseen circumstances and events beyond the control of the Organizer, the registration fee remains non-refundable. The Organizer may, at its discretion, provide participants with the option to transfer their registration to the rescheduled date, subject to the Organizer’s terms and conditions.

Medical Treatment

I consent to receive any medical treatment which may be advisable or needed in the event of injury, accident, or illness during the Event, as determined by a medical professional. I shall be solely responsible for all costs of medical treatment, emergency evacuation, hospitalization, and any related expenses arising from my participation in the Event. The Organizer shall not be liable for any medical costs, treatment expenses, or consequential losses arising therefrom.

False Declaration

I declare that all information provided in my registration is true, accurate, and complete to the best of my knowledge. I understand that knowingly providing false or misleading medical information, among others, is strictly prohibited and may result in immediate disqualification from the Event.

Equipment and Bicycle Mechanical Roadworthiness

I warrant that my bicycle and any and all accessories and equipment I bring to and use during the Event meet applicable safety standards and are in good working condition. I acknowledge that the Organizer has no obligation to inspect, certify, or warrant my equipment, and that any failure or defect in my equipment is solely my responsibility.

Disqualification and Removal

The Organizer reserves the right, in its sole discretion, to disqualify, remove, or impose a ban on any participant at any time, without refund, for violations of safety rules, unsportsmanlike conduct, use of another person’s race kit, or any other conduct determined by the Organizer to be prejudicial to the Event. Such disqualification or removal shall not give rise to any liability, cause of action, or claim for compensation against the Organizer.

Data Privacy

I hereby consent to the collection, use, storage, and disclosure of my personal data, including but not limited to my name, contact details, medical declarations, and images, by the Organizer for the purposes of Event administration, emergency medical response, post-Event communications, and marketing and promotional activities, in accordance with Republic Act No. 10173 (Data Privacy Act of 2012). I understand that I may withdraw my consent with respect to non-essential processing at any time by written notice to the Organizer.

Emergency Contact

I have provided accurate emergency contact information as part of my registration. I authorize the Organizer and its on-site medical team to notify my designated emergency contact in the event of injury, illness, or emergency arising during my participation. The Organizer shall not be liable for any failure to successfully reach my designated emergency contact.

Governing Law and Jurisdiction

This Release and Waiver of Liability shall be governed by and construed exclusively under the laws of the Republic of the Philippines. Any dispute, claim, or controversy arising out of or in connection with this Release, including any question regarding its existence, validity, or termination, shall be submitted to the exclusive jurisdiction of the appropriate courts of Marikina City, Metro Manila, Philippines.

Severability

If any provision of this Release and Waiver of Liability is held by a court of competent jurisdiction to be invalid, void, or unenforceable, the remaining provisions shall continue in full force and effect and shall not be affected, impaired, or invalidated in any manner.

Interpretation and Construction

I understand that this Release and Waiver of Liability shall be interpreted and construed in favor of the Organizer. In no case will I claim that I was coerced or misled to execute this Release and Waiver of Liability, nor will I argue that I was made to sign the same without my knowledge of its terms and conditions.

Acknowledgment of Understanding (“Pagkilala sa Pag-unawa”)

I confirm that I have read, understood, and voluntarily accepted all the terms and conditions of this Release and Waiver of Liability, which has been made available to me in both the English and Filipino languages. I acknowledge that I was given sufficient time and opportunity to read and understand its contents, and that I am executing this document freely and without any force, duress, intimidation, or undue influence.

Kinukumpirma ko na nabasa ko, naunawaan, at kusang-loob na tinanggap ang lahat ng mga tuntunin at kundisyon ng Release and Waiver of Liability na ito, na ibinigay sa akin sa wikang Ingles at Filipino. Kinikilala ko na binigyan ako ng sapat na oras at pagkakataon upang basahin at maunawaan ang mga nilalaman nito, at na isinasagawa ko ang dokumentong ito nang malaya at nang walang anumang puwersa, pamimilit, pananakot, o di-wastong impluwensya.
